GENEALOGY OF STACY SMITH COX
Cox, **Thomas
_________________________________________________________
A search for Thomas Cox in the 1810 North Carolina Census turned up eight individuals with that name. Only one had a family enumerated close to the right age. This is Thomas Cox Jr. who is enumerated in the 1810 Rowan Co., NC Census (page 61 or Ancestry.com image page 47). Enumerated right beside Thomas Jr. is a Thomas Cox (who must be "Sr." as his age indicates), following him is a Henry Russell. Enumerated just eight dwellings before Thomas Jr. is a Joseph Doulhite. I believe this Thomas Jr. is "our" Thomas and that the Thomas Cox next to him is his father. The proximity of the Doulhite, who could possibly be Mary Dollarhide's brother, contributes to this assumption. Also, the fact that Thomas' oldest son William married a Russell and Thomas is enumerated by a Henry Russell could be more than coincidental. Thomas Jr.'s family is enumerated as follows:
~ 1 white male under age 10
~ 1 white male age 26-45
~ 2 white females under age 10
~ 1 white female age 16-26
~ 2 white females age 26-45
(NOTE: Perhaps the two "extra" adult females living in the household are Thomas' sisters or sisters-in-law?)

A search for Thomas Cox in the 1820 Census showed just one Thomas Cox in Indiana (Orange Co., IN in Greenfield Twp). Based on other censuses that shed further light on the ages of his children and the fact that this Thomas Cox in Orange Co. is enumerated as between the age of 16-26, I don't think this is our Thomas. I suspect he moved from North Carolina to Ohio first, then to Indiana.

The material that Jane sent me included a will of Thomas Cox dated 17 Sep 1822 and recorded in Henry Co., IN 23 Sep 1822. It is the first will recorded in Henry County. Here's a transcription of the copy I have:
RECORD OF WILLS
Last Will and Testament of Thomas Cox deceased (From Ledger "A" Probate, page 1, 5 & 6) State of Indiana, Henry County SS:
The Last Will and Testament of Thomas Cox, deceased was present by the oaths of William Brown and Thomas Wiles subscribing witnesses thereto, and ordered to be recorded. And William Cox, one of the Executors, named in the said Last Will and Testament (Mary Cox the other Executrix, named in said Will, refusing to take upon herself the Executrix-ship of said Will) took the oath required by law and together with Absalom Harvey, his Security, entered into and acknowledged their Bonds in the penalty of Two Thousand Dollars, conditioned as the law directs, and thereupon Letters testamentary were granted to the said William Cox.
Rene Julian, Clerk of the probate Court, this the 23rd day of September, 1822.
Know all men by these presents, that I, Thomas Cox, of the State of Indiana, Henry County, Henry Township, being of sound mind and memory, but in a week [sic] state of health and wishing to dispose of my personal property, that it has pleased God to bless me with, do make and ordain this my last Will and Testament in order to dispose of it in the following manner, (to wit:)
First, I wish all my last debts to be paid out of property;
Second, I give and bequeath unto by beloved wife, Mary Cox, one horse beast - her choice of my stock - and three cows and calves and of all and singular of my household and kitchen furniture, during life or as long as she shall remain my widow; And at the expiration of that time to be sold and equally divided amongst my beloved Children and if she should marry to draw an equal share with them. Also, I wish land to be bought with what money there is on hand of mine and further wish my wife to have her maintenance on it and to raise my children to her _?_ life or widowhood and no longer, and a reasonable portion of my farming utensils at the discretion of my executors. &
3. I give and bequeath unto my little sons (namely), William, Daniel, Elijah, Abijah, and Dillon all of the land that can be bought with what money there is on hand, at the discretion of my executors amongest the above named.
4th I give and bequeath unto my daughters their equal part of the balance of the proceeds of the rest of my property that is named with the boys, that is every one to have an equal share of what is not named and willed away.- And further I wish to sell my property to be disposed of to the best advantage for the benefit of my children at the discretion of my executors.
And lastly I do appoint my beloved brother William Cox, and my beloved Wife Mary Cox, Executors to this my last will and testament to do and to do [sic] and to act for me and my heirs. In testimony I have hereunto set my hand and seal this the Seventeenth day of September in the year of our Lord One Thousand Eight Hundred and Twenty Two.
Signed in the presence of us M. Brown Thomas Cox seal Thomas Wiles.

There are other records at the Henry Co., IN Courthouse pertaining to Thomas's estate. They are on pages 7, 18, 63, 119 and 342 of Probate Order Book A-B. I found one entry that said that Daniel and Elijah had received their portion. I also found a entry (not included in this list of page numbers, I don't think) in which the County Sheriff was issued a certificate (warrant?) to locate William Cox and Mary Cox in Wayne Co. (Sorry, I didn't make notes since I planned to run copies, but was not able to do so). The next entry, which is on p. 68, is one I already had a copy of. Here is what it says:
(November Term 1831, 21 Nov 1831)
Matters relating to the estate of Thomas Cox, deceased. Now comes Joseph Rich executor of William Cox, who is executor of Thomas Cox deceased and it appearing from former Records made in this Court that the sum of One Hundred and Thrity Three dollars and fifty three and a quarter cents with interest amounting to Twenty six eighty two cents to balance which said executor files the receipt of William Cox and Polly Swarengin amounting to Forty dollars and thirty two cents bring their receipts in full as heirs of said Estate. And also said Executor files other receipts amounting to one Dollar and seventy eight cents, leaving still in the hands of the executor one Hundred and Eighteen Dollars and Twenty eight cents. And it is ordered and adjudged by the Court that said executor pay the costs of the citations in this Estate, and the further settlement of this Estate is continued eighteen months.
The last entry I found was recorded in August of 1837:
In Re
Estate of Thomas Cox
Joseph Rich executor of the estate of Thomas Cox deceased comes and files a receipt from William Anderson for Twenty Five Dollars in full of their legacy of said estate and also files vouchers for amounts paid out on said estate one dollar forty five cents.
